Ulta re-sells returned beauty products as new, lawsuit claims

A lawsuit claims that beauty product chain Ulta repackages returned cosmetics and sells them to unsuspecting customers.

“It is widespread knowledge that this practice has been occurring at Ulta for years,” attorney Tom Zimmerman said.

Zimmerman represents a local woman who works in the beauty industry and became suspicious about the some of the products purchased from Ulta.

The complaint filed last week in Cook County Circuit Court cites claims by former employees of Ulta that the corporation has a limit on how many returned items can be thrown away.

“Managers will take used products out of a damaged bin and if they look good enough to resell, they’ll put them back on the shelves and resell them so they don’t exceed their quota,” Zimmerman said.

Zimmerman said some products purchased from the Ulta store on North Michigan Avenue seem to be previously used, such as eyeshadows missing a brush and face cleansers that have already been opened. He said the danger comes in pathogens that can remain on products for weeks.

“There is E. coli and klebsiella bacteria which is commonly found in intestine and expelled with fecal matter,” he said.

Some Ulta customers told ABC7 they are surprised by the allegations.

“Personally, I’ve never experienced that. All of my products that I’ve bought from there have been in good condition,” customer Nailah Golden said.

A spokesperson for Bolingbrook-based Ulta said in a statement:
“Our policy does not allow the resale of used products. We are aware of the lawsuit and intend to vigorously defend against the allegations. The health and safety of Ulta Beauty guests is a top priority and we strive to consistently deliver an optimal experience every time they shop with us.”

Zimmerman said the lawsuit is seeking to change the alleged company practice of limiting the number of items that can be thrown away, as well as compensating people who bought used products.

Another lawsuit was also filed last month by a California woman who claims the same thing.

The Best Nude Lipstick for Your Complexion

A swipe of nude lipstick is an effortless way to, well, look like you made some effort. As long as the shade flatters your skin tone, that is. “The perfect nude makes your face look fresh and youthful, but a lot of women get it wrong and pick something too light, too opaque, or too beige,” says makeup artist Nick Barose, whose clients include Lupita Nyong’o, Uzo Aduba, and Brie Larson. We’re hoping this guide through the overwhelming world of taupes, toffees, and caramels will help you get it just right.

Taking an extra minute to prep your lips can be the difference between a nude lip that looks pretty and one that looks pasty. Start by layering on a moisturizing balm. Makeup artist Ricky Wilson swears by Dior Dior Addict Lip Glow (he’s an ambassador for the brand). “I use it under every nude lipstick to condition the mouth and lend a hint of color that prevents washout. It also makes the liner application easier,” he says. Tilt your head back and outline your mouth using the side rather than the tip of a pencil (choose one the same color as your lipstick, he says). The end result will look natural without any harsh lines.

Now that you’re properly prepped, it’s time to decide whether or not you want to play up the pink-y tones in your lips. If the answer is yes, stick to pale, rosy nudes à la Audrey Hepburn in Breakfast at Tiffany’s. “I love a satin texture that’s not too creamy,” says Wilson. Avoid matte finishes, especially with lighter shades, since they can leave lips looking ghostly. Add a touch of bronzer to warm up your complexion and define your eyes with liner (soft and smudgy or sharp and defined) and black mascara.

Prefer to take the natural rosiness in your lips down a notch? Try a sheer, light taupe or beige instead. A word of caution: Steer clear of orangey nudes, which can make paler complexions appear sallow, warns Wilson.

Golden-beige shades enhance olive complexions rather than compete with them. It’s the reason Jennifer Lopez often chooses the color for the red carpet. Go for sheer textures that won’t read lighter than your skin, and try Barose’s sneaky trick to prevent severe lines: Gently sketch a pencil along the Cupid’s bow and the outer corners only. It provides a polished finish that’s hard to pull off when you outline your entire mouth.

For a more impactful statement, go for peachy nudes (nothing yellow, please!) that complement the green undertones in olive skin. These shades help warm up your complexion so you won’t look washed out, says Barose. His pick: Nars Audacious Lipstick in Anita. If you want to ensure long-lasting wear, Wilson advises a matte option, like Urban Decay Vice Lipstick in Uptight.

“Sometimes on medium tones, the outer edges of the lips tend to be a bit darker,” explains Wilson. In these cases, select a color that suits the perimeter of your mouth — a technique he uses on clients to guarantee the color won’t appear chalky around the rim. Salmon-pink nudes with a hint of orange are a safe bet to unify the entire lip hue, he says.

When selecting a neutral for dark tones, keep this in mind: “Your nude is definitely not going to read nude in the tube,” says Barose. “If it looks nude, then it’s too light and it will look like concealer on your lips,” he says. A swipe of a metallic bronzy brown always flatters thanks to a hint of shimmer, which reflects light so the color won’t appear flat or vanish on your mouth.

To cancel out the lip color completely (a request Wilson often gets from his clients with dark skin), “I generally pick a pencil shade that matches the outer edge of the mouth,” he says. Use that to fill in your lips, then top it with an opaque caramel or toffee lipstick. If the texture feels too dry, dab on a touch of clear gloss in the center of your mouth to add moisture. “It makes every nude look more sensuous.”

We all love a MAC lippy. Sometimes (when we think we’re flush with money – and we’re very clearly not) we buy one just because we like the colour… and then probably use it about twice in our lifetime.
